T&C for User

These General Terms & Conditions for the Drivers/Suppliers constitute anintegral part of each user contract (2ndHand Users) entered BETWEEN MATRIX FUTURE TECHNOLOGIES SDN BHD (the “Client”) and the “USERS” made and entered into this.

IN CONSIDERATION OF and as a condition of the Client and USERS entering into this Agreement and other valuable consideration, the receipt and sufficiency of which is acknowledged,the parties to this Agreement agree as follows”

 

 

1)     DEFINITIONS

The following terms and words used in these terms and conditions have the following meaning:

  1. "The Client" refer to Matrix Future technologies Sdn Bhd & Click MyGas and the parties that work under it or are involved with it.
  2. "Context" refers to all information provided in these terms and conditions.
  3. "Both parties" refers to both the User and Matrix Future Technologies Sdn Bhd, as well as all other parties involved.
  4. "You" refers to the Click MyGas app's Users.

 

2)     FORMATION

  1. These terms and conditions agreement applies to all "USERS" that are under or enters into a Contract with the Client.
  2. These terms and conditions are purposed to serve both "USERS" and the Client for the benefit of all.
  3. These terms and conditions include all the possible issues that can be encountered in Click MyGas App and purposed to ensure Click MyGas App's efficiency.
  4. The Client may amend and update this terms and conditions at any time.
  5. Any updates that the Client have made will be updated to the USER through email.
  6. These terms and conditions can be modified or amended under any circumstances for the benefit of both parties.
  7. We reserve the right to modify the terms and conditions without being liable to you if there are any encounters with price changes, modification in the app system.
  8. You shall use our service that is limited to the terms and conditions stated. Upon any disagreement to these terms and conditions you are not allowed to use our service.

3)     YOUR (THE USERS) RESPONSIBILITY

  1. You are to install the software on your mobile device;
  2. The service that we provide is to connect the Delivery Person, Supplier and User through an app to facilitate all parties.
  3. You will be able to see the details about the delivery person's distance so that you can choose your order according to your preference for distance and the estimated time of delivery.
  4. You are required to provide valid and true information about yourself upon registration as the user of Click MyGas App.
  5. We shall also verify your identity.
  6. For the verification process, a Type Approval Code (TAC) will be sent to your device, upon receiving the code you will need to insert it in the space provided in the app.
  7. The services that provided solely exclusive to the user of the account only.
  8. You have the rights to delete your account at your own interest.
  9. You prohibited to use our service without the existence of your User account.
  10. Your collected points cannot be redeemed once you have deleted your account,
  11. The points are only valid when the account is active and valid.

4)     PRIVACY

  1. All the information provided by you will be kept safely and protected from any third parties under the Personal data Protection Act.
  2. Your identification card details, driving license and other personal details would not be shared to any third parties.
  3. We only assure to secure your personal information safely from our end;
  4. The confidentiality of the information provided will also be subjected to your internet provider and smartphone/device security.
  5. You shall be granted the right to access and make changed to your personal data in circumstances where it is outdated or inaccurate.
  6. Any misleading or inaccurancy in personal data should be directly reported to us and we shall take all the measures in accordance with PDPA policy to implement the changes.
  7. Your personal data will be fully erased when it no longer serves the applications functionalities in accordance with the retention policy.

5)     PROVISION OF THE SERVICE

  1. The Client provides its service to you through your mobile device and smartphones with the connection of internet in your devices.
  2. The Client's App limits access to provide its efficient services and tend to delay with pooor internet connection.
  3. The Client's App will also be unavailable if any of the following situations occur:an emergency, any unexpected circumstances, system failure, or any unavoidable situations with no prior notice.

6)     RESTRICTED MATTERS

  1. You are restricted from committing any act that is contrary to these terms and conditions.
  2. You are not permitted to allow third parties or anyone else to use your user account.
  3. You are restricted from posting anything negative or any type of post, story or comment in any social media, or other media that could harm the reputation of Click MyGas App.
  4. You are strictly prohibitly from trying to interrupt Click MyGas App's system or try to make fraudulently by impersonation with fault identity or other's identity.
  5. You shall not provide false identity upon your registration as a user.
  6. You are prohibited fromm giving false information on the delievry address and payment details.
  7. You are restricted from sharing your user ID, password or any other information pertaining to your user account to third parties.
  8. You are not allowed to change the address of delivery upon the placing of the order.
  9. You are restricted to get personal information or contact details of the delivery person.
  10. You are restricted from uploading information or flies that conatin any viruses.
  11. You should not attempt to interfere or try to compromise the intef=grity of the system in any way.

7)     USER RESPONSIBILITIES

  1. You are responsible to provide all required infromation for registration in order to access the Click MyGas App's service.
  2. You are responsible to secure your password.
  3. You shall not upload any details that are false or invalid.
  4. You should use the Click MyGas App in an appropriate way and avoid cancelling upon placing them.
  5. You are responsible for providing the right and accurate address for delivery to avoid any complications with the delievry process.
  6. You are also encouraged to let us know your review about the service provided by Click MyGas App in Click MyGas App's review.
  7. You are solely reponsible for the usage of your account, including keeping your username and password confidential and being solely liable for any activities performed using your user account.
  8. Upon every order thata re amde, we will charge an additional amount of RM5.00 as a proof of order confirmation.
  9. If you cancel the order, we shall deduct an amount of RM5.00 from your account.
  10. If there are no problem with your order, we will reimburse the payment back to your account.
  11. You are responsible for acquiring and updating your device whenever necessary to enable you to access the Click MyGas App and its service.
  12. You are responsible to provide an accurate and correct order.
  13. You are required to take responsibility for any extra fees in the event the delivery address differs from the keyed in details in the App.

 

8)     SUSPENSION/TERMINATION OF THE ACCOUNT

  1. Your account will be temporarily suspended upon any mischievous or suspicious activities committed while using your user account and would not be recovered until we ensure your account is safe to operate.
  2. our account will be automatically terminated upon any confrimation of false document, information or wrongful activities (uploading virus, trying to hack the system, trying to conduct fraud, posting spam or any other crimes).
  3. Any activities such as using the app to gain personal interest can leas to suspension of your account.

9)     LIMITATION OF LIABILITY

  1. The Client is liable to take any actions on the Users due to any malicious activity.
  2. The Client can take any legal or appropriate action on the Users upon any violation of the terms and condition stated.
  3. The Client has all the rights to deduct your payment if there are any false or incorrect information during the personal details being keyed in.

10)     NOTIFICATION AND CONTACT 

  1. Any notifications will be shown in the app's notification and to send important messages we will send it through SMS or emails.
  2. You can contact us through the app's customer service by sending us message in the chat which will be replied by our customer service in charge person as soon as possible.
  3. ANy further complication shall be handled through emails.
